Renting out a room or kot in Belgium: do you need a permis de location?
Renting out a room in Wallonia? What the permis de location is, what it costs in 2026, and the fine you risk without one.

The question we hear most from people arriving in Brussels to study is always the same: "what if I leave before the contract ends?" In some Belgian cities the answer is uncomfortable. In Brussels it is friendlier to the student, but only if what you sign is genuinely a student lease. It is what people searching for a student room in Brussels, a kot in Belgian terms, ask us most.
It is the housing contract the Brussels Housing Code provides for tenants who are studying: it runs for at most 12 months and can be renewed each year on the same terms. According to the Region's official guide, to sign it you must prove you are a student with proof of enrolment or of an enrolment application.
Three details change the outcome:
Two months, with no penalty, and you can give it at any point during the contract. The official guide says so, and the landlord can only end the lease at its expiry date, with three months' notice.
The practical rules, based on the Brussels Government's official model contract:
Our verdict: it is one of the most flexible exit regimes for a tenant in Belgium, which is why it is worth insisting on a student lease. But it is not the same across the country: Flanders has different rules, which we explain in what is a kot in Leuven.
In the Brussels Government's official model student lease, the deposit cannot exceed two months' rent. With rent of €500 a month, the maximum is €1,000. It must be placed in a blocked account in your name, not handed to the landlord in cash; the full mechanism, including the electronic deposit, is in renting in Brussels as an expat.
To get it back when you leave, the decisive document is the entry état des lieux, the inventory of the room's condition with photos: how to do it in a shared room. If you are offered a different type of contract, ask in writing for the amount and where it is held.
As an order of magnitude, between €400 and €650 a month according to student housing guides, and more if the room is furnished and comes with services. That is a sector estimate, not an official figure. For the furnished rooms in shared flats that we list in Ixelles, Etterbeek or the European Quarter, the usual range is €650 to €900 a month.
To check whether the price of a specific room is reasonable, compare it with the Brussels rent grid. And always ask what is included: heating, electricity and internet add up quickly when billed separately.
Six things, in writing:
For landlords: a student lease is only signed if both sides agree, you cannot end it before its expiry, and to prevent renewal you must give three months' notice. Registering the lease within two months and attaching the energy certificate are your obligations. Stating the contract type and duration in the listing saves messages and misunderstandings.
For anyone searching: many of our users tell us that what costs them most on arrival is knowing which type of contract they are being offered. Ask before you view. Roomie-Radar connects landlords with qualified users searching for a room, and using Roomie-Radar is free.
The Brussels student lease gives the tenant an exit almost no other Belgian contract offers: two months' notice, no penalty, at any time. But it only works if the contract is genuinely a student lease, with a deposit of at most two months and registration on time.
